Stress related ulcers from the medication could definitely be a problem, particularly if Toby is already fighting ulcers (which the treatment would suggest).
Obviously your vet isn't keeping up with the literature. While it's true that biaxin alone doesn't seem to kill helicobacter, the combination of amoxicillin and biaxin seems to be very effective. Print out this article and take it to your vet:
