I recently switched vets for much the same reason and demanded and was given
all records including all x-rays done on my dogs. The reason medical doctors
keep x-rays is to maintain evidence in the event of a malpractice claim, and
I'm assuming your vet is doing the same thing. However, while laws here in
New York allow medical doctors to retain all records and charge a fee to
release information, no such laws cover vets. I am not a lawyer, but work in
the legal field and may I suggest the following:
1) Request the records and x-rays in writing, return receipt requested. I
know she already refused but this way you document your request.
2) You need to find the applicable laws in your states are they relate to
vet. See if you can locate who in your state licenses vets, that agency may
be able to tell you the law governing vets records. If you have a local law
school, you can go to the law library and ask a librarian to assist you in
searching it yourself.
3) If you'd rather not go through the hassle, or come up empty, try suing in
small claims court. It will likely cost you about $10 to file, and it might
make her rethink her position.
4) File a complaint with the veterinary equivalent of the AMA.
In rereading this it sounds too aggressive - but I truly believe that vet is
acting in an unprofessional manner - particularly threatening not to turn
over any information to the new vet. There's always a few bad apples in
every profession - hope you have much better luck with your new vet.
